1. About these terms

These Terms of Use apply to your use of the TALBioBank™ website (the “website”), which is operated by [Touch-A-Life Foundation — full legal entity name], [registered address] (“TAL”, “we”, “us”). By using the website, you agree to these terms. If you use it on behalf of an organization, you confirm that you are authorized to do so. If you do not agree, please do not use the website.

Our Privacy Policy explains how we handle personal information.

2. Information only — no offer or agreement

The website describes TALBioBank, which is currently in early access. Its content is general information and may change. Descriptions of features, deployment models, data types and uses describe intended or available capabilities. They are not a commitment that any particular feature, dataset or service will be available.

Nothing on the website is an offer, and submitting the contact form does not create any agreement. Contributing data to, or accessing data through, the TALBioBank platform is only possible under separate written agreements, applicable participant consent and any required ethics or regulatory approvals.

3. Not medical advice

The website does not provide medical, clinical, legal or regulatory advice, and it is not a substitute for professional judgment. Do not rely on it for diagnosis or treatment decisions.

4. Acceptable use

You agree not to:

  • use the website unlawfully, or in a way that infringes anyone’s rights;
  • try to gain unauthorized access to the website or its systems, or interfere with how they work, including by introducing malware or overloading them;
  • scrape, harvest or collect content or information from the website by automated means without our written permission;
  • pretend to be another person or organization, or misrepresent your connection with one;
  • send us unsolicited advertising or spam through the website.

5. What you send us

When you contact us, you agree to give accurate information. Do not send patient information, protected health information or other sensitive personal data through the website. Do not send confidential information either: unless we agree otherwise in writing, we have no duty of confidentiality for information sent through the website, apart from our obligations under the Privacy Policy.

6. Intellectual property and trademarks

The website and its content, including text, graphics, logos and design, belong to TAL or its licensors and are protected by intellectual property laws. You may view the website and print or download extracts for your own non-commercial reference, as long as you keep all proprietary notices. You may not otherwise copy, modify, distribute or use the content without our written permission.

TALBioBank™, TALAiVa™, TALHospitals™, TALMedora™, TALBloodAid™, Touch-A-Life and related logos are trademarks of TAL. You may not use them without our prior written permission.

7. Third-party names and links

The website mentions other organizations and programs, such as UK Biobank, NIH All of Us and BBMRI-ERIC, only as illustrative examples of types of biobanks. Mentioning them does not imply any affiliation, endorsement or partnership, and their names and marks belong to their owners.

Links to other websites are for convenience. We are not responsible for the content, policies or practices of those websites.

8. Disclaimer

The website is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, that the website will be accurate, complete, uninterrupted, secure or free of errors or viruses. This includes any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the fullest extent the law allows, TAL is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from your use of, or inability to use, the website. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Governing law

The courts of [venue — confirm] have exclusive jurisdiction over any dispute, except that you keep any mandatory protections given by the law of the country where you live.

11. Changes and general terms

We may update these terms at any time by posting a new version here with a new “Last updated” date. If you keep using the website after that, you accept the updated terms. We may also change, suspend or withdraw the website at any time.

If any part of these terms is found to be unenforceable, the rest stays in effect. If we do not enforce a provision, we do not waive it. These terms are the entire agreement between you and us about the website. Separate written agreements govern any use of the TALBioBank platform.
